1. Acceptance of Terms
By accessing or using the AfraWaya platform (website and mobile applications), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
AfraWaya reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the modified terms.
2. Services Description
AfraWaya is an online marketplace that connects travelers with local service providers across East Africa, including:
- Tour operators and activity providers
- Hotels, lodges, and accommodations
- Villa and vacation rental owners
- Car rental companies
- Event organizers
AfraWaya acts as an intermediary platform and is not the direct provider of travel services. The contract for services is between you and the service provider.
3. Account Registration
To use certain features of our platform, you must:
- Be at least 18 years old or have parental consent
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use
- Accept responsibility for all activities under your account
4. Bookings and Payments
4.1 Booking Process
- All bookings are subject to availability and confirmation by the service provider
- Prices displayed are in USD unless otherwise indicated
- Additional taxes and fees may apply depending on the destination
- You will receive a confirmation email once your booking is confirmed
4.2 Payment Terms
- Payment is required at the time of booking unless otherwise stated
- We accept major credit cards, debit cards, and mobile payment methods
- All transactions are processed securely through our payment partners
- Currency conversion rates are determined by your payment provider
4.3 Price Guarantee
Once a booking is confirmed and paid for, the price is guaranteed. We do not charge additional fees unless you modify your booking or incur additional services.
5. Cancellations and Refunds
5.1 Cancellation by Customer
- Free Cancellation: Most bookings can be cancelled free of charge up to 24-72 hours before the activity date (varies by provider)
- Partial Refund: Cancellations within 24 hours may receive a partial refund (50-75%)
- No Refund: No-shows or same-day cancellations typically do not qualify for refunds
5.2 Cancellation by Provider
If a service provider cancels your booking, you will receive a full refund. We will assist you in finding alternative arrangements when possible.
5.3 Refund Process
Refunds are processed within 5-10 business days. The time for funds to appear in your account depends on your payment method and financial institution.
6. User Responsibilities
When using AfraWaya, you agree to:
- Provide accurate information for all bookings
- Arrive on time for scheduled activities
- Comply with all local laws and regulations
- Respect service providers, their staff, and other travelers
- Follow safety instructions and guidelines
- Obtain necessary travel documents (visas, vaccinations, etc.)
- Not engage in illegal or harmful activities
7. Limitation of Liability
AfraWaya acts as a marketplace connecting travelers with service providers. We are not liable for:
- Actions, errors, or omissions of service providers
- Personal injury or property damage during activities
- Changes to services due to weather, political situations, or force majeure
- Loss of personal belongings
- Indirect or consequential damages
Our maximum liability shall not exceed the total amount paid for the affected booking.
8. Travel Insurance
We strongly recommend purchasing comprehensive travel insurance that covers:
- Trip cancellation and interruption
- Medical emergencies and evacuation
- Lost or delayed baggage
- Personal liability
9. Intellectual Property
All content on the AfraWaya platform, including text, images, logos, and software, is owned by AfraWaya or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. User Content and Reviews
By submitting reviews, photos, or other content to AfraWaya, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content. You represent that your content is accurate and does not violate any third-party rights.
11. Dispute Resolution
Any disputes arising from the use of AfraWaya shall be resolved through:
- Step 1: Contact our customer support team
- Step 2: If unresolved, submit a formal complaint in writing
- Step 3: Mediation through an agreed-upon third party
- Step 4: Binding arbitration under the laws of Djibouti
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Djibouti. Any legal proceedings shall be conducted in the courts of Djibouti City.
